IRS Can Levy Your Social Security FOREVER


IRS Chief Council has issued an advisory that if a levy is outstanding to the social security administration on your outstanding IRS balance, that levy will stand even past the Collection Statute Expiration Date ("CSED") date. The IRS stats that a levy, specifically on Social Security income under IRC §6331(a), would continue after the expiration of the CSED due to the fact that the taxpayer has a fixed and determinable right to future payments of social security income at the time the levy arose.
